The Justice Department sued Penn State on Thursday over who qualifies for its lower in-state tuition rate. The dispute concerns undocumented students living in Pennsylvania and U.S. citizens who live outside the state.
In its complaint, the department argues that federal law bars the university from giving a tuition benefit to undocumented students based on residency unless U.S. citizens from other states can receive the same benefit. It alleges that Penn State’s policy treats those groups differently.
For students budgeting for college, the distinction matters: the filing asks a court to intervene. The complaint itself does not set a new tuition rate or decide any individual student’s eligibility.
